Terms of Service

1. Acknowledgement

This End User License Agreement ("EULA") is a legal agreement between you ("End-User") and LooksyAI ("Developer," "we," "us," or "our") for the use of the LooksyAI mobile application ("Licensed Application").

You and we acknowledge that this EULA is concluded between you and LooksyAI only, and not with Apple Inc. ("Apple"). LooksyAI, not Apple, is solely responsible for the Licensed Application and the content thereof.

This EULA does not provide for usage rules that are in conflict with the Apple Media Services Terms and Conditions, which you acknowledge you have had the opportunity to review.

2. Scope of License

LooksyAI grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

The Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time, except as permitted by the Usage Rules.

3. Maintenance and Support

LooksyAI is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA, or as required under applicable law.

You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. Warranty

LooksyAI is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be LooksyAI's sole responsibility.

THE LICENSED APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOOKSYAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5. Product Claims

You and we acknowledge that LooksyAI, not Apple, is responsible for addressing any claims of you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to:

• Product liability claims;
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement;
• Claims arising under consumer protection, privacy, or similar legislation.

This EULA does not limit LooksyAI's liability to you beyond what is permitted by applicable law.

6. Intellectual Property Rights

You and we acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, LooksyAI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
• You are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, if you use the Licensed Application over a wireless data connection, you must not be in violation of your wireless data service agreement.

10. Description of Service

LooksyAI is an AI-powered virtual try-on application that allows users to upload photos and visualize themselves wearing different outfits using artificial intelligence technology. The Service uses AI to generate images and results may vary.

11. User Content

You retain ownership of any photos or content you upload to the Licensed Application ("User Content"). By uploading User Content, you grant LooksyAI a worldwide, non-exclusive, royalty-free license to use, process, and display your User Content solely for the purpose of providing the Service to you.

You represent and warrant that you own or have the necessary rights to all User Content you upload.

12. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, threatening, or abusive
• Upload content that infringes on intellectual property rights
• Attempt to reverse engineer, decompile, or hack the Licensed Application
• Upload content containing nudity or explicit material
• Use the Licensed Application for any unlawful purpose

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOOKSYAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE LICENSED APPLICATION, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY.

14. Termination

This EULA is effective until terminated by you or LooksyAI. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application.

15. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Santa Clara County, California.

16. Changes to This EULA

We reserve the right to modify this EULA at any time. We will notify users of any material changes by posting the new EULA on this page and updating the "Last updated" date.
